1. Acceptance of Terms

By accessing or using the website marwilsafety.com or any services provided by Marwil Safety LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.

2. Services

Marwil Safety provides:

• MSHA Part 46 and Part 48 training (New Miner and Annual Refresher), delivered live virtually or on-site
• Outsourced safety management and consulting for mining and contractor companies
• Mining consulting, including on-site assessments, MSHA violation representation, and compliance audits
• Safety compliance software (VeriField Pro™)

Specific terms for training, consulting, or safety management are set forth in separate agreements or proposals. These Terms apply to your use of our website and general engagement with us.

3. Training Registration and Payment

When you register for MSHA training:

• Payment is due as specified at the time of registration. We accept payment via Stripe.
• Cancellation or rescheduling may be subject to fees as stated in our class registration materials.
• Completion of training does not guarantee MSHA certification; you must meet all course requirements.

4. Consulting and Safety Management

Consulting and safety management services are governed by separate written agreements. We act in an advisory capacity and do not assume control of your operations, personnel, or worksite conditions. We cannot guarantee that you will not be inspected or cited by MSHA or other regulatory bodies.

5. Limitation of Liability

To the fullest extent permitted by law, Marwil Safety LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of our website or services. Our total liability shall not exceed the amount you paid us in the six (6) months preceding the claim.

6. Indemnification

You agree to indemnify and hold harmless Marwil Safety LLC and its agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your operations, or your violation of these Terms.

7. Intellectual Property

All content on this website, including text, graphics, logos, and materials, is the property of Marwil Safety LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maryland.

9. Changes

We may modify these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the modified Terms.
